So, the UK has voted to exit the European Union (EU). Some clients have been asking what this means for protection of their EU trade mark registrations in the UK
Until the UK formally exits the EU, nothing changes. It is anticipated that the exit process will take around 2 years. Part of the exit negotiations will address what will happen in relation to EU trade marks moving forward. This includes what will happen to applications and registrations in place before the exit. This creates some uncertainty over the next few years. However, at this stage general thinking is that an arrangement will be reached to ensure continued protection of existing applications and registrations in the UK after exit. Moving forward, it is likely that separate trade mark applications will be required for the UK
